Membership Terms – Terms of Book Distribution.

These Subscriber Terms (together with the documents referred to in it) are the terms on which you subscribe to our services provided through our website https://creaklelibrary.com/ (our site), whether as a guest, a registered user or otherwise, and through our Book Distribution service. Use of our site includes but is not limited to accessing, browsing, or registering to use our site.

Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of this for future reference.

By using our site, you confirm that you accept these Subscriber Terms and that you agree to comply with them. If you do not accept all of these terms and conditions, you are not authorised to use our site. If you do not agree to these terms of use, you must not use our site.

These Member terms are subject to the following additional terms, which also apply to your use of our site:

Registration and creation of your Member Subscription

In order to register as a [Member] with Someone’s Book, you are required to confirm your acceptance to be bound by these Terms.

Your application to register as a Member and your continued use of the Website will also constitute your acceptance of these Terms, and your acceptance to comply with our Website House Rules Policy, Acceptable Use Policy, Privacy Policy (together, the "Policies").

In applying to be a Member, you warrant that: (a) you are at least 16 years of age; (b) you are a resident in the United Kingdom; (c) the email address provided in connection with your Membership is your email address.

We reserve the right to verify the identity, age and/or address of any user at any time and a failure to comply with such verification may result in the termination of your access to your Membership.

As part of the registration process you shall be required to provide your email address and create a username and password ("Login Details"). In order to participate in book distribution and our associated services, you will be required to login with your Login Details. You are responsible for the security of your Login Details and we will not be liable for any unauthorised access to your Account arising from your failure to keep your Login Details secure.

We will confirm the acceptance of your registration via email to the email address provided by you during the registration process and at such point you will become a Someone’s Book Member, however we reserve the right to withdraw its acceptance and terminate your access to your Account at any time.

Someone’s Book may, in its sole discretion, reject or change your Login Details at any time and shall notify you in the event that such changes are applied. You are advised to refer to our Acceptable Use Policy in relation to the creation of usernames.

From time to time we offer incentives and benefits for our Members. You are therefore responsible for updating any personal details (including address, telephone number and/or any other contact information) in order to receive details of such offers. We will not be liable for your failure to keep your contact details up to date which may result in your inability to participate or benefit from any such offers.

Terminating your Account

You may terminate your Membership with us at any time by contacting us via e-mail at [EMAIL] or visiting someonesbook.com and following the online process on your user profile page for cancellation. We will confirm that your Account is terminated by sending an email to you.

We may immediately terminate any agreement between us and terminate your access to your account in the following circumstances: (a) any breach by you of the Policies or any other terms between us; (b) any breach by you to supply correct and true information or any failure to verify your identity, age or address when requested by us.

Changes to these terms

We may revise these terms of use at any time by amending this page. By continuing to use our site you indicate your acceptance of any revised terms of use as and when they are revised.

Changes to our site

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

We do not guarantee that our site, or any content on it, will be free from errors or omissions.

Book Distribution

Book distribution is the sole responsibility of each Member and must adhere to the following Someone’s Book rules.

Books must only be left at pre-designated Book Drops, except where the permission of the owner/manager of any premises/location that is not yet designated as a potential Book Drop is sought. The owner must first sign up to the website before any books can be left.

Any books you leave at a Book Drop must adhere to the following rules:

  • Books that promote hate or violence towards groups based on race, ethnicity, religion, disability, gender, age, veteran status or sexual orientation/gender identity are forbidden.
  • Books with overt religious or political bias intended to incite others is forbidden.
  • Sexually explicit books are forbidden.
  • Any books promoting the abuse of Children in any form are forbidden.
  • Books that encourage or provide information or instruction on performing any act that is illegal in the UK or any other jurisdiction.
  • Books with any content that is deemed unlawful including the instructions for a conduct of an illegal activity, criminal offence, give rise to civil liability, violate the rights of any party in any country in the world, or that would otherwise create liability or violate any local, national or international law.
  • Books whose content may infringe any patent, trademark, trade secret, copyright or other intellectual property or other proprietary right of any party. In particular, content that promotes an illegal or unauthorised copy of another person's copyrighted work.

Anyone found misusing the Book distribution programme will be removed and banned from our membership.

International Book Distribution

Although most books, including books to international destinations, are distributed without incident, books to certain destinations may involve greater personal risk for the sender than others. Someone’s Book urges you to investigate and review book prohibitions, warnings, announcements and advisories issued by the U.K. Government, the European Union (EU) and destination country governments prior to sending books to international destinations.

By listing information relevant to books sent to particular international destinations, we do not warrant or represent that books sent to such places are advisable or without risk, and therefore we are not liable for any liability, litigation, loss, damages, costs or expenses that may result from sending books to such destinations.
